Privacy Policy

At Genkinfy LLC («Genkinfy», «we») we take your privacy seriously. This policy explains what personal data we process, for what purpose and under what legal basis, as well as the rights you are entitled to. Genkinfy is a company incorporated in the United States that provides services to and addresses businesses in Europe, which is why we apply the General Data Protection Regulation (GDPR, EU 2016/679) to those located in the European Economic Area, together with any applicable United States legislation.

2. Scope
This policy covers two types of individuals whose data we may process:
- Visitors of the website genkinfy.com and individuals who contact us or book a consultation.
- B2B campaign prospects: professionals at companies we contact by cold email for legitimate commercial purposes, as part of our lead generation service (on our own behalf or on behalf of our clients).
3. What data we process
From visitors and contacts
- Identification and contact data that you provide to us voluntarily (name, email, company, message) when you write to us or book a call.
- Technical and browsing data (IP address, device and browser type, pages visited) collected through cookies and similar technologies. See our Cookie Policy.
From B2B prospects
- Professional contact data: first and last name, job title, company, professional email address and, where applicable, public professional profile (for example, LinkedIn) and the company's sector or size.
We do not seek to process special categories of data (sensitive data). We ask that you do not provide them to us.
4. Purposes and legal bases
We process your data for the following purposes:

5. Source of prospect data
When you have not provided your data to us directly, we obtain it from lawful sources that are publicly or professionally accessible, such as: professional directories and networks (for example, LinkedIn), corporate websites and B2B databases from providers that guarantee a legitimate origin of the information. We process only professional contact data, not data from the personal or private sphere.
6. Commercial communications and opt-out
Our B2B communications are addressed to professionals for legitimate commercial reasons related to their activity. In all our emails we include a simple way to unsubscribe and stop receiving them. You can also object at any time by writing to us at cesar@genkinfy.com; we will handle your request and stop contacting you.
7. Recipients and data processors
We do not sell your personal data. To provide our services we share data with providers acting as data processors following our instructions and with the appropriate contractual safeguards, among them:
- Outbound email sending and automation platforms (for example, Smartlead).
- Website hosting and infrastructure provider.
- Meeting scheduling platform that we use for consultation bookings.
- Web analytics provider (Google, through Google Analytics), when you have given your consent.
We may also disclose data where there is a legal obligation or where it is necessary to defend our rights.
8. International transfers
Genkinfy is established in the United States and some of our providers process data outside the European Economic Area. When we transfer data of individuals in the EEA to the United States or other countries, we do so relying on appropriate safeguards under the GDPR, such as the Standard Contractual Clausesof the European Commission and/or the provider's adherence to the EU–US Data Privacy Framework, together with additional measures where appropriate. 9. Retention periods
We retain data only for as long as necessary for the purposes described: contact and client data, for the duration of the relationship and the applicable legal periods; B2B prospect data, for as long as it is relevant to our prospecting and you do not exercise your right to object or unsubscribe; and analytics data, according to the retention periods configured in the tool. After that we delete or anonymise it.
10. Your rights
If you are located in the EEA, the GDPR grants you the following rights over your data:
- Access: to know what data of yours we process.
- Rectification: to correct inaccurate or incomplete data.
- Erasure («right to be forgotten»): to request that we delete your data.
- Restriction and portability of processing.
- Objection, in particular to direct marketing, in which case we will immediately stop processing your data for that purpose.
- Withdraw consent at any time, without this affecting the lawfulness of prior processing.
To exercise them, write to us at cesar@genkinfy.com. If you believe we have not handled your request correctly, you may lodge a complaint with the competent supervisory authority; in Spain, the Spanish Data Protection Agency (AEPD).
11. United States residents
If you reside in the United States, depending on your state (for example, California, under the CCPA/CPRA) you may have the right to know the categories of data we collect, to request their deletion and to opt out of their «sale» or «sharing». We do not sell personal data. You can exercise these rights by writing to us at cesar@genkinfy.com.
12. Security
We apply reasonable technical and organisational measures to protect your data against unauthorised access, loss or alteration. No system is completely infallible, but we work to maintain a level of security appropriate to the risk.
13. Minors
Our services are addressed to businesses and professionals. They are not intended for minors and we do not knowingly collect their data.
14. Changes to this policy
We may update this policy to reflect legal changes or changes in our services. We will publish the current version on this page with its last updated date.
